With the fairly recent changes to the immigration laws in the UK, it has become increasingly difficult for the individual to ensure that s/he will be able to navigate the process in order to secure an appropriate UK Visa.

 

The UK now has a points based system (PBS) which migrants must satisfy before a UK visa can be issued. The PBS scheme comprises of the following:

 

  • Tier 1, which itself consists of subcategories for General Applicants (previously HSMP), Post Study Work (formerly IGS), Entrepreneur, and Investor. This tier is for migrants with desirable professional skills.

 

  • Tier 2 (formerly the work permit scheme), itself consisting of subcategories: Tier 2 Work Permit, Change of Employment, Intra-Company transfers. This tier is for skilled workers with an offer of employment.

 

  • Tier 3 is for temporary low skilled workers (it replaces the Seasonal Agricultural Workers Scheme (SAWS) and the Sectors Based Scheme (SBS)). This tier is for temporary low skilled workers.

 

  • Tier 4 is for students.

 

  • Tier 5 is for temporary employment / youth mobility schemes.

 

Tiers 3, 4 and 5 are considered temporary and do not ordinarily lead to settlement .

 

Visas for visit purposes, family members (from outside of the European Economic Area) and dependent leave, are not within the PBS and are subject to their own complex rules.
